MixCraft Mobile App – Terms of Service

These Terms of Service govern your use of MixCraft, our website, and any related services provided by Fortitude I.T. Development LLC.

By creating a MixCraft account or using the MixCraft app, you agree to comply with these Terms of Service and all applicable laws and regulations. If you do not agree with these Terms, you must not continue using the MixCraft app, our website, or any services provided by Fortitude I.T. Development LLC.

If you access or download MixCraft from (1) the Apple App Store, you agree to any Usage Rules set forth in the App Store Terms of Service; and/or (2) the Google Play Store, you agree to the Android and Google Play Terms of Service.

We, Fortitude I.T. Development LLC, reserve the right to update or modify these Terms at our sole discretion. When changes are made, this page will be updated and you may be notified within the app and/or via email. All changes take effect immediately upon publication.

Limitations of Use

By using MixCraft, you agree that you will not:

  1. modify, copy, create derivative works of, decompile, or reverse engineer MixCraft or any software or materials contained within the app or website;
  2. remove any copyright or proprietary notices contained within MixCraft or its materials;
  3. transfer MixCraft or its materials to another person or “mirror” them on any other server;
  4. knowingly or negligently use MixCraft in a way that disrupts networks or services provided by Fortitude I.T. Development LLC;
  5. upload, publish, or transmit unlawful, obscene, fraudulent, or harmful content through MixCraft;
  6. use MixCraft in violation of any applicable laws or regulations;
  7. send spam or unauthorized advertisements through MixCraft;
  8. collect or harvest user data without consent;
  9. use MixCraft in a way that infringes on the privacy, intellectual property, or rights of others.

Intellectual Property

All intellectual property related to MixCraft is owned or licensed by Fortitude I.T. Development LLC. You are granted a limited, personal-use license to download and use MixCraft on your device. This license does not transfer ownership and will automatically terminate if you violate these Terms.

Automatic Updates

You authorize MixCraft to download and install updates automatically according to your device settings. You may revoke this permission at any time by uninstalling MixCraft.

Liability

MixCraft and all related materials are provided on an “as is” basis. Fortitude I.T. Development LLC makes no warranties, expressed or implied, and disclaims all other warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall Fortitude I.T. Development LLC or its suppliers be liable for any consequential, indirect, or incidental damages, including but not limited to loss of profit, data, revenue, business, goodwill, or use.

Some jurisdictions do not allow limitations on implied warranties or liability, so some limitations may not apply to you.

Accuracy of Materials

The information provided in MixCraft or on our website is for general informational purposes only. Fortitude I.T. Development LLC does not guarantee accuracy, reliability, or results from the use of these materials.

MixCraft may contain links to third-party websites. Fortitude I.T. Development LLC is not responsible for the content of any linked site and does not endorse or control these external resources. Use of third-party links is at your own risk.

Notice Regarding Apple

If you access MixCraft on an iOS device, you acknowledge that Apple Inc. is not responsible for MixCraft or its content. Apple is not obligated to provide maintenance or support.

If MixCraft fails to comply with any warranty, you may notify Apple for a refund of the purchase price. Beyond this, Apple has no further warranty obligations.

Apple is not responsible for claims related to product liability, legal compliance, consumer protection, or intellectual property infringement.

You agree to comply with all applicable third-party terms when using MixCraft on an Apple device.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

You represent and warrant that you are not located in a restricted or embargoed country and are not listed on any U.S. Government restricted-party lists.

Right to Terminate

We may suspend or terminate your MixCraft account immediately upon written notice if you breach these Terms.

Severance

If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force.

Governing Law

These Terms of Service are governed by U.S. law. You agree to submit to the exclusive jurisdiction of the courts in the applicable state or region.
